These terms explain the rules for using SiteSwap and the responsibilities of buyers, sellers and other users of the marketplace.

SiteSwap is an online marketplace designed to help users advertise, discover and communicate about construction materials, tools, equipment and other permitted items.
SiteSwap provides the platform that connects buyers and sellers. Unless specifically stated otherwise, SiteSwap is not the buyer, seller, owner or supplier of items advertised by users.
By creating an account, accessing SiteSwap or using its marketplace features, you agree to these Terms & Conditions.
If you do not agree with these terms, you should not use SiteSwap.
Users are responsible for providing accurate information when creating and maintaining an account.
You are responsible for keeping your login details secure and for activity carried out through your account.
You must not create an account using false information, impersonate another person or business, or use SiteSwap for unlawful activity.
Businesses may create business accounts and provide information such as a business name and Australian Business Number (ABN).
Users are responsible for ensuring that business information they provide is accurate and that they have authority to act on behalf of the business.
Any verification feature provided by SiteSwap does not guarantee the quality, reliability or trustworthiness of a business or its goods.
Sellers are responsible for the accuracy of their listings.
Listings should clearly and honestly describe the item being offered, including its condition, quantity, location and any important defects or limitations.
Sellers must have the legal right to sell or otherwise offer every item they list on SiteSwap.
Users must not list stolen goods, illegal goods, counterfeit goods, dangerous or prohibited items, or items that cannot legally be sold.

View Prohibited ItemsBuyers and sellers are responsible for agreeing on the price, payment method, collection, delivery and any other terms of their transaction.
Users should inspect items and satisfy themselves that an item is suitable before completing a transaction.
SiteSwap does not guarantee that a buyer or seller will complete a transaction.
SiteSwap does not currently process, receive, hold or transfer payments between buyers and sellers.
Users arrange payment directly with each other and are responsible for choosing a suitable and lawful payment method.
SiteSwap is not responsible for payments made directly between users, including payment disputes, chargebacks, non-payment or fraudulent transactions.
SiteSwap may provide tools that allow users to generate invoices or transaction records.
These tools are provided for convenience only. An invoice generated through SiteSwap does not mean that SiteSwap has verified the transaction, received payment, guaranteed payment or confirmed the accuracy of the information entered.
Users remain responsible for ensuring their invoices and business records meet any legal, accounting or tax requirements that apply to them.
SiteSwap provides messaging features so users can communicate about listings and transactions.
Users must not use SiteSwap messaging to harass other users, send spam, attempt fraud or distribute unlawful or harmful material.
Reviews should reflect genuine experiences between users.
Users must not submit false, misleading, abusive or manipulated reviews.
SiteSwap may remove reviews that breach marketplace rules.
Users may report listings, reviews or accounts that they believe breach SiteSwap rules.
SiteSwap may review reports and take action where appropriate, including removing content, restricting accounts or suspending users.
Users may also block other users using the tools available on the platform.
SiteSwap may restrict, suspend or remove an account where there is suspected misuse of the platform, fraudulent activity, repeated rule violations or other behaviour that may put users or the marketplace at risk.
SiteSwap may also remove listings or other content that breaches these terms or marketplace rules.
Users are responsible for taking reasonable precautions when arranging transactions or meeting other users.
This includes checking items carefully, avoiding suspicious payment requests and using suitable locations for in-person transactions.

Features may be changed, added, restricted or removed as the platform develops.
Users remain responsible for the listings, photographs, messages, reviews and other content they upload or submit to SiteSwap.
You must have the right to use and upload any content you provide.
By uploading content required for a listing or profile, you allow SiteSwap to display that content as necessary to operate the marketplace.
SiteSwap branding, website design, software and platform content owned by SiteSwap must not be copied, reproduced or used without permission, except where permitted by law.
SiteSwap provides a platform for users to connect with each other. SiteSwap is not responsible for inspecting every item, verifying every statement made by users or supervising transactions between buyers and sellers.
To the extent permitted by law, users are responsible for decisions they make when buying, selling, collecting, transporting or using items obtained through the marketplace.
Nothing in these terms is intended to exclude rights or protections that cannot lawfully be excluded.
These terms may be updated as SiteSwap develops, introduces new features or changes how the marketplace operates.
The date shown at the top of this page indicates when these terms were last updated.
These terms are intended to operate under the applicable laws of Australia.
Additional laws and consumer protections may apply depending on the circumstances of a transaction and the location of the users involved.
